Welcome to PIXAFY.IO (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of pixafy.io and any products, downloads, templates, or services we offer (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

1) Eligibility & Account

You must be at least 16 years old (or the age of digital consent in your region). You are responsible for the accuracy of information you provide and for keeping your order details and files secure.

2) Digital Products & License

Unless stated otherwise, purchases grant you a personal, non-exclusive, non-transferable license to use the digital files for your own job search or professional profile. You may not resell, redistribute, sub-license, or share the files publicly.

3) Pricing, Taxes & Changes

Prices may change at any time. Taxes/VAT may apply based on your location and will be shown at checkout. We may modify or discontinue products with or without notice; changes will not affect orders already completed.

4) Payments & Checkout

Payments are processed by third-party providers (e.g., Stripe, PayPal, Gumroad, Payhip, WooCommerce). By placing an order, you agree to their terms and policies. We do not store full payment details on our servers.

5) Delivery & Access

Digital items are delivered via download links or account access after successful payment. Keep backup copies of your files; we are not obligated to re-issue links indefinitely.

6) Refunds

We offer a 7-day money-back guarantee for digital products unless a product page states a different policy. To request a refund, email pixafy.io@gmail.com with your order ID within 7 days of purchase. On approval, you agree to delete all downloaded files and stop using the materials. Custom services and completed coaching sessions are non-refundable.

7) Subscriptions (If Applicable)

First-time purchases may be refundable within 7 days. Renewals can be canceled anytime and will remain active until the end of the paid period; already-started billing periods are generally non-refundable.

8) Acceptable Use

• No unauthorized copying, public sharing, or resale of files.
• No scraping, reverse engineering, automated downloading, or circumvention of access controls.
• No unlawful, harmful, defamatory, or infringing use of our Services.

9) Intellectual Property

All content, product designs, text, graphics, and trademarks on the Services are owned by or licensed to PIXAFY.IO and protected by applicable IP laws. No rights are granted except as expressly stated in these Terms.

10) User Content & Feedback

If you submit feedback, testimonials, or suggestions, you grant us a worldwide, royalty-free license to use, reproduce, and display such content for promotion and improvement, unless you explicitly revoke that permission in writing.

11) Third-Party Links

We may link to third-party websites or tools. We are not responsible for their content, policies, or practices. Access at your own risk.

12) Privacy

Your use of the Services is subject to our Privacy Policy. We only use your data as described there (e.g., order fulfillment, support, product updates).

13) Disclaimers

Our digital products are provided “as is” and “as available”. We do not guarantee any specific hiring outcome. Results vary based on execution, role fit, and market conditions. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

14) Limitation of Liability

To the maximum extent permitted by law, PIXAFY.IO, its owners and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits. Our total liability for any claim is limited to the amount you paid for the product/service giving rise to the claim.

15) Indemnification

You agree to defend, indemnify, and hold harmless PIXAFY.IO from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services.

16) Changes to the Services or Terms

We may update these Terms at any time. Updates take effect when posted on pixafy.io. Continued use after changes means you accept the revised Terms. We will reflect the “Last updated” date at the top.

17) Governing Law & Dispute Resolution

These Terms are governed by the laws of your country/region of operation. If you sell primarily to Morocco/EU/US, specify the jurisdiction (e.g., “England & Wales”, “California, USA”, or “Morocco”). Any disputes shall be resolved in the courts of the specified jurisdiction.

18) Termination

We may suspend or terminate access if you violate these Terms or use the Services unlawfully. Upon termination, your license to use the digital files ends unless allowed by a separate written agreement.

19) Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and PIXAFY.IO regarding the Services.
• Severability: If any provision is unenforceable, the remaining provisions remain in effect.
• No Waiver: Failure to enforce a provision is not a waiver of our rights.
• Assignment: You may not assign your rights without our consent.
• Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
